APGA Crisis:Court Dismisses Application Seeking To Oust Oye
A Federal High Court, sitting in Awka, the Anambra capital on Thursday dismissed the interlocutory application for an Order of Mandatory Injunction against Dr Victor Oye, National Chairman of All Progressives Grand Alliance (APGA).
The order was sought by Chief Edozie Njoku who is laying claim to being the authentic chairman of the party.
Hon Justice Nganjiwa who presided over the matter on July 1 ruled that the reliefs sought by the applicant were substantially the same as the reliefs sought in the substantive suit.
The court held that granting such application would amount to prejudice to the hearing of the substantive suit before the court.
It would be recalled that one Barr Sopulu Ezeonwuka had approached the Federal High court, Awka Judicial Division vide Suit No. FHC/AWK/CS/35/2021 praying the Honourable Court to recognise Njoku as the National Chairman of APGA .
Ezeonwuka prayed the court to compel Njoku to conduct primary election on behalf of APGA for the Nov. 6 governorship election in Anambra.
After considering the matter, the Court dismissed the application for lack of merit.
A Motion for joinder filed by Oye would be heard by the court on the next adjourned date, July 7.
The ruling consequently affirmed Oye as the National Chairman of APGA and Prof Chukwuma Soludo the product of June 23 primary election as the valid candidate of the party.
