EEDC Loses N100m Suit Against Activist Obi
A Federal High Court sitting in Awka has dismissed the suit instituted by the Enugu Electricity Distribution Company (EEDC) seeking damage of N100 million against Mr Osita Obi, an Awka based human rights activist.
The court presided over by Justice Bala Khalifa-Mohammed Usman delivered the ruling on Suit No. FHC/AWK/CS/07/2020 in Awka on June 19, 2026.
EEDC had sued Obi for allegedly leading protests over poor power supply and persistent power outages in Anambra State.
The company demanded N100 million in damages.
But when the matter was called up for hearing on Friday, counsel to EEDC failed to appear.
Mr Martin Obi, counsel to the appellant urged the court to dismiss the suit and award N1 million in costs against EEDC,
Obi argued that EEDC had not shown seriousness in pursuing the case which was instituted in 2019 and passed through several jurisdictions, including Abuja, Enugu and Awka.
He said it had caused the defendant considerable expenses and inconvenience as the repeated absence of the company showed it was not interested in prosecuting the matter.
In his ruling, Justice Usman struck out the case for lack of diligent prosecution.
The Judge held that the case could no longer be sustained due to the applicant’s failure to diligently prosecute it.
He however, declined the defendant’s request for an award of N1 million in costs against the applicant.
