Setback For Anosike As Court Rejects Motion To Set Aside Sack Judgment

 

 

A Federal High Court sitting in Abuja on Monday struck out Sen. Emma Anosike’s motion seeking to nullify the judgment that sacked him and his executive.

 

Anosike through his counsel, Ojukwu SAN and Najim Esq. who represented APC had prayed the court to set aside his sack and reinstate him.

 

Mr Tony-Uche Ezekwelu, the State Publicity Secretary of APC who disclosed this in a Statement said the court held that it had no jurisdiction as the case was already at the Court of Appeal.

 

He said the court advised the plaintiffs to withdraw their motion of set-aside on the grounds that it had no jurisdiction to entertain such.

 

“The Court ordered all parties to prosecute their case at the Court of Appeal,” he said.

 

On the motion for Stay of Execution, he said the court granted it only on a temporary basis because there was no evidence before it that it had been effected.

 

 

He said Chief Ifeanyichukwu Osegbo’s, through his lawyer, informed the court of his intention to furnish it with the report of the Execution of the Judgment which was completed on July 3.

 

Ezekwelu said nothing changed as the party was still under the chairmanship of Osegbo.

 

He congratulated the APC in Anambra and urged members to remain calm.
